Terms of Service

Kink-Folio (“Service,” “we,” “us,” or “our”) is operated by SageWorkx LLC, a limited liability company organized under the laws of the United States. By accessing or using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to create an account or use Kink-Folio. You represent that all registration information is accurate and that you will maintain its accuracy.

2. Accounts & security

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at support@kink-folio.com if you suspect unauthorized access.

3. User content

You retain ownership of content you upload (profiles, portfolios, photos, forms, messages). You grant SageWorkx LLC a non-exclusive, worldwide license to host, display, and transmit your content solely to operate the Service. You are solely responsible for ensuring you have rights to all content you publish and that it complies with our Content Policy and applicable law.

4. Acceptable use

• No illegal content, harassment, non-consensual imagery, or exploitation of minors
• No malware, scraping, or attempts to bypass security or rate limits
• No impersonation of others without permission
• No use of the Service to facilitate trafficking, coercion, or violence

We may suspend or terminate accounts that violate these rules or pose risk to users or the platform.

5. Adult content

Kink-Folio is designed for adult-oriented personal and professional expression. Portfolios may include age gates and password protection. You agree not to expose minors to adult material and to use age verification features where appropriate.

6. Payments & beta

Features may change during beta or early access. We do not guarantee uninterrupted availability. Paid features, if offered, will be described at purchase with applicable refund terms.

Our Privacy Policy explains how we collect and use personal information.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE MATCHING, SAFETY OF IN-PERSON MEETINGS, OR ACCURACY OF USER-GENERATED CONTENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAGEWORKX LLC AND ITS MEMBERS, OFFICERS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

10. Indemnity

You agree to indemnify SageWorkx LLC against claims arising from your content, conduct, or breach of these Terms.

11. Changes

We may update these Terms. Material changes will be reflected by a new effective date and version. Continued use after changes constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Disputes shall be resolved in courts located in the United States, unless otherwise required by applicable consumer protection law.
